1. Acceptance of Terms
By accessing or using RestWell Memorials (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and RestWell Memorials. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
RestWell Memorials is an online platform that allows families and individuals to submit, publish, and share obituary announcements and memorial tributes for deceased persons. Our Service includes:
- Submission and publication of obituary announcements.
- A public directory of published memorials.
- The ability for visitors to leave tributes, messages, and condolences.
- Optional add-on services including newspaper, radio, and television announcements.
- Optional donation features to support bereaved families.
3. User Accounts
To submit an obituary, you must create an account. You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Submissions and Content
4.1 Your responsibilities
By submitting an obituary or tribute, you represent and warrant that:
- You have the right and authority to submit the content.
- All information provided is accurate and truthful to the best of your knowledge.
- The content does not infringe any third-party intellectual property rights.
- You have obtained consent to use any photographs submitted.
- The content does not contain defamatory, obscene, or unlawful material.
4.2 Our review process
All obituary submissions are reviewed by our team before publication. We reserve the right to reject, edit, or remove any submission that violates these Terms or our content standards, without obligation to provide a refund where payment has been made.
4.3 Licence to content
By submitting content, you grant RestWell Memorials a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the content on our platform for the purpose of providing the Service.
5. Payments and Refunds
Payment for obituary submissions is processed securely via Paystack. All prices are displayed in Nigerian Naira (NGN).
- Payment is required before an obituary is reviewed and published.
- Refunds are available if your submission is rejected by our team. Refunds will be processed within 5–10 business days.
- No refunds are issued for approved and published obituaries, or for add-on services that have already been fulfilled.
- Chargebacks: Initiating a chargeback for a legitimately processed payment may result in account suspension.
6. Tributes and Condolences
Visitors may leave tributes, messages, and condolences on published obituary pages. By submitting a tribute, you agree that:
- Your message is respectful, truthful, and appropriate to the context.
- You will not use the tribute feature for spam, advertising, or harassment.
- We may remove any tribute that violates these Terms without notice.
7. Donations
Some obituary pages may include a donation feature to support bereaved families. RestWell Memorials acts solely as a facilitator and does not hold, manage, or guarantee donated funds. Donations are made directly to the bank account provided by the submitting family.
We are not responsible for the use of donated funds. Donors should exercise their own judgement before making a donation.
8. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fabricated obituary information.
- Impersonate any person or entity.
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorised access to any part of the Service.
- Scrape, crawl, or harvest data from the Service without permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to harass, abuse, or harm any individual or family.
9. Intellectual Property
All content on the RestWell Memorials platform — including the website design, logo, text, and software — is the property of RestWell Memorials and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by Nigerian law, RestWell Memorials shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or emotional distress.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the three (3) months preceding the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
